Question:

 

Hi, my partner and have a joint mortgage, she was living in the home, I left, I paid her to bring the mortgage upto date after being in arrears by one month after I left, she didnt pay the mortgage company, she kept the money, and now it's 3 months in arrears. she has now left the home and moved to a rental, how could I move back to the property but with her removed from the mortgage, I could pay the arrears etc, but wouldnt be willing to do this with her on the title, thank you for your assistance.

Answer:

 

You do have a dilemma. As long as your partner is on title she has rights with respect to the property. The only way for the situation to work for you is if you settle the property legally through a matrimonial lawyer but there may be restrictions regarding removing her from the title while the mortgage exists.
